My complaint:

I made one year contract with Telfort on 5th of June from internet, actually to get new Samsung Galaxy S2 smartphone within the contract and internet. I paid 89 euros for the phone. I received phone on 8th of June. In one week, I start to get problem with the phone; it was getting too hot (not on battery part, on hardware part) and battery life in the end was 16 minutes 23 seconds (after 4-5 hours of charge, while it is closed, because when it is open it can’t charge). I even tried resetting to factory settings, and also gave it to Samsung service point for software update but they say this phone needs to go factory. It is Samsung problem but my contact is Telfort, I paid to Telfort to give me a working phone and they are wasting time in every possible procedure that they call to hold responsible of this. I called client service 4-5 times already. First (17th of June) they said i need to wait for a sticker that they will send, so i can send the phone back to them. After 7 workdays (that is the time unit here, 11 days in my agenda), I haven’t still got a sticker.. 8th workday I called, then they said, i can leave the phone to a Telfort store (???, why didn’t they say before). I left it to a store in Enschede and after 3 workdays, the website was showing still it is at store, so I went back to store, they said they already sent it so I shouldn’t have trusted to website (??? then why do you give it to me to check). I called again to make the “procedure” faster a little, after long conversation, i said i want to cancel my contract. then client service guy says, there is a problem at the moment so i shall call later. By the way, i am paying for this so called service 30 cents per minute, and one conversation takes 5-8 minutes, depends how much you get frustrated. I called again, and this time their system was working, i asked before starting conversation.. The the person behind the phone tells me that this is the procedure and i knew that (??) I said how come i could pay for such procedure, i didn’t know that I would get a crappy phone, I didn’t know that they would danger my health with a phone that has pretty good chance to explode at my ear or pocket, I didn’t know that it would get more than 7 workdays (not even received at 10th workday) to send an envelope. I didn’t know that i would be behaved like i am telling all lies, i didn’t know that i would work and pay for such client torturing instead of client service. I tried to get it before I go for vacation but with such service noone can. In two weeks i could only give the phone to the store.

After 23rd workday (31st Gregorian Calendar day) has also passed with no result since my first call and my first email on 17th of June. There was no sticker in my postbox. They sent a mail that they are sorry that they didn’t respond in 10 workdays. The repairer TelePlan’s site says:
“Wacht op onderdelen (1-2 weken). Uw toestel wacht op levering specifiek benodigde onderdelen. In de meeste gevallen worden deze binnen 1 – 2 weken geleverd.”

I don’t deserve a repair, as phone was kaput in one week. What parts by the way? this is a phone of 1 week, how could i be held responsible of this? I didn’t damage the phone, this is not like dropping phone and breaking front glass. I believe if they request, samsung would give them a new phone already. If not then tell what I did… unbelievable… They don’t let me know anything… When I call TelePlan they don’t answer my questions, and they tell i shall call Telfort. When I call Telfort, all they say is ‘wait’.

10 workdays (14 calendar days) ago (6th of July), I asked again from their site to cancel my contract. They responded on saturday (16th of July) that they are sorry that they couldn’t respond in 10 workdays (probably they are counting saturday too because it was 9th workday after the request if you count saturday), they ask me to wait another 10 workdays. It is just getting funnier each day.

I asked my bank to return of first month payment and I also asked my bank to stop all future payments to Telfort. Only thing that i can’t get 89 euros cash that I gave on delivery of the phone. My colleague will help also make a written complaint but as customers all we can do is just write, call, get frustrated, etc. and the response we get is just wait.. no results, no service that we are paying for.

I don’t have the phone that I paid for since 15th of June and since that time, I don’t use internet that i am paying for.

Desired solution:

Their solution is I wait, which is a period that i am paying, taken from my account.
I want them to cancel my contract, return the money that they took for phone and also for new contract period. Remove the promotions that i got in this three weeks (like maybe free internet) and charge them with normal price from my account. I fulfilled my end on the contract (paying everything, and my money works, it also gives warmth to them that they won\'t complain) but they didn\'t fulfill their end on the contract

all I can do is to complaint here.. their client service is just wasting time, just call, make you wait 5 minutes, let you talk and say just wait and age.. and charge that crap.. if someone knows a better way, please let me know.. In some countries there are volunteered lawyers who would take such cases for sake of public consumers. Is there any organization that would take such interest? non-profit, if i earn anything from such case, i would just donate, my concern is public consumer’s sake and my money.

all i want is to cancel my contract so I can move to another network.

14 years ago - 8th workday, still no sticker at my postbox. I've given the phone to a telfort store already but i want to state how slow is the process.. I didn't know this procedure (as they claimed that I knew ???) but i hope some customers can start to learn more about these..

14 years ago - 9th workday (13th day in Gregorian Calendar) after my email and first client 'service' call that they said i will be receiving a sticker. There is still no sticker at my postbox, there is still no response for my email with reference CM110617000051. I still can't believe how they can say to me that i knew this procedure.. they know this but not customers, they live with such ignorance, they are getting what they want, withdrawing money from account. if i don't let them then they will be charging interest because of 1 day delay in the payment... then also they won't be counting only workdays !!

14 years ago - 10th workday, there is no sign of sticker in my postbox, no sign of email response in my email inbox, finally today there is a sign on repair site that it is under inspection of repairer (In behandeling bij reparateur (doorlooptijd 1 -2 werkdagen), it takes another 2-3 workdays to send phone back, so middle or end of next week, which i will return 2 weeks later from vacation and i won't have chance to test the phone). if they repair, it means they need to open the hardware part and still i won't feel safe about the phone. I didn't drop the phone, I didn't scratch it, i didn't damage it, i behave like it is a precious... I believe i deserve a new phone or cancellation of my contract.. from these two, i would still choose second option. I don't want to go through this client 'service' again.

I am on vacation, thousands km far, not able to check postbox. no response on email address (I am also monitoring my junk mail lists even domain is listed as safe). Repairer's site is not working, doesn't show details of my phone. "Technische problemen. Probeer het later nogmaals. Excuses voor het ongemak." later later and later...

14 years ago - 12th workday, repairer's site still shows Technical problem that I am not able to check status of the phone. Last night, for a period, I saw message: In behandeling bij reparateur (doorlooptijd 1 -2 werkdagen) which I noticed on 10th workday.

14 years ago - 13th workday (17th Gregorian Calendar day). There is still no email in my email inbox, I don't know if there is a sticker in my mailbox (but there was no on 10th workday). I am following status from my vacation, can't call with amounts that they charge (i am already paying over 30 euros extra in 13 days) after 3 workdays, repairer's site still shows "In behandeling bij reparateur (doorlooptijd 1 -2 werkdagen)". Last time when i called TelePlan company they told me to call Telfort not them. According to Telfort i need to wait.. What kind of service is this.. I don't have any fault in this, only paying money to this crap.

14 years ago - 14th workday (18 Gregorian Calendar days), still no response in email inbox, Repairer TelePlan's site still shows "In behandeling bij reparateur (doorlooptijd 1 -2 werkdagen)." after 4 workdays. Last time when I called, I told them i want to cancel my contract, they told me to wait status of phone. Yesterday from Telfort site, I again made a complaint and cancellation request, but an automatic email response says they will respond within 10 workdays. All lies and wasting of precious time, nevertheless they are getting their money. all I can do is to complaint here.. if someone knows a better way, please let me know.. In some countries there are volunteered lawyers who would take such cases for sake of public consumers. Is there any organization that would take such interest? non-profit, if i earn anything from such case, i would just donate, my concern is public consumer's sake.

14 years ago - I think they are kidding me... or just punishment to write here (if they notice this site) The repairer TelePlan's site now says : Wacht op onderdelen (1-2 weken). Uw toestel wacht op levering specifiek benodigde onderdelen. In de meeste gevallen worden deze binnen 1 - 2 weken geleverd. 1-2 weeks !!!! they don't even respond within days that they mention. this will take 4 weeks i guess. 14 years ago - I am on my vacation and still checking.. they ruined 4 weeks of my time.. still nothing.. 19th workday (25th Gregorian Calendar day)has also passed with nothing. The repairer TelePlan’s site says: “Wacht op onderdelen (1-2 weken). Uw toestel wacht op levering specifiek benodigde onderdelen. In de meeste gevallen worden deze binnen 1 – 2 weken geleverd.” I can't call because of extreme roaming prices and without hope on getting a response other than saying 'wait'

They haven't responded to that message yet too.. but they said 'within 10 workdays' let's wait that too..

I believe if they request, Samsung would give them a new phone already. They don’t let me know what they are doing… When I call TelePlan they don’t answer me, and they tell i shall call Telfort. When I call Telfort, all they say is ‘wait’ and even in their last response they asked me about the status of the phone (???) 15 workdays (18 calendar days) ago, I asked again from their site to cancel my contract. One week ago they responded that they couldn’t respond in 10 workdays, they ask me to wait another 10 workdays. It is just getting funnier each day. A few days ago they responded: "You pointed out that a while ago you ordered a abonnement with phone at Telfort. After you used the phone for 1 week it gave you a lot of troubles. You send it to us to be repaired but in your opinion this took too long. Since you accepted the phone and used it it won't be possible to cancel your contract. On top of that you used and you are still using the services of Telfort. Because of these reasons we can't cancel your contract. To conclude this e-mail we would like to know what the status of your phone is now. We hope we informed you sufficiently with this e-mail" I wanted to send a long message to tell my reasons but there was 500 character limit. right now I keep my old phone open so they can contact me. I only use as much as SimOnly package but i paid and i am paying for a smartphone and internet. I asked my bank to return of first month payment and I also wanted to ask my bank to stop all future payments to Telfort. But some legal advisor told, i don't have such rights in the contract. They have all the rights. I or we as customer don't have any. We just pay. My colleague helped make a written complaint but as customers all we can do is just write, call, get frustrated, etc. and the response we get is just wait.. no results, no service that we are paying for. I am trying to put this story in more places. for more than 3 weeks, their partner repairer TelePlan’s site puts same message: “Wacht op onderdelen (1-2 weken). Uw toestel wacht op levering specifiek benodigde onderdelen. In de meeste gevallen worden deze binnen 1 – 2 weken geleverd.” I don’t deserve a repair, as phone was kaput in one week which i strongly believe a defect of manufacturer problem, I didn’t ask for repair either, i gave them so they could check that i am telling truth and the phone has manufacturer problem. I don’t have the phone that I paid for since 15th of June and since that time, I don’t use internet that i am paying for. So all i am asking to cancel the contract, return my money and then charge that whole period with normal tariffs like i didn't have one year contract.

14 years ago - After - 42 days without the phone - 41 days since my first call about the problem - 35 days since i hand the phone to them - 27 days since i requested cancellation on phone call - 22 days since i requested cancellation on their site - 7 days since I refunded first month payment through "terugboeken incasso" on my bank - 1 day since I sent emails to some Telfort directors/managers, they agreed on cancellation of my contract. Alternative offer was receiving new phone but i have no interest left to continue with Telfort. So it is gonna be cancelled and my costs will be refunded. Today repairer site updated the status of the phone, as shipped (which i will send back instant that i receive) For the record: Klachtomschrijving: ACCU LAADT NIET OP / IS SNEL LEEG Batterij wordt niet goed opgeladen en het toestel wordt heel heet.
